What Is an FSSAI State License?

An FSSAI state license is the food licence granted by your state's food safety department to mid-sized food businesses. It sits between basic FSSAI registration for small businesses and the central licence for the largest businesses and special categories. It is applied for on Form B under the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, and issued on Form C with a 14-digit licence number.

From 1 April 2026, a state license FSSAI requires is needed by food businesses with annual turnover above ₹1.5 crore and up to ₹50 crore, as long as they are not in a category that needs a central licence. In India, applications are filed on ONDLS or your state drug licensing portal and decided by the State Drug Licensing Authority. FSSAI expects more than 98% of food businesses to fall under state authorities after the 2026 changes, so the state licence is now the main licence for growing food businesses.

Like every FSSAI licence issued from April 2026, the state licence has perpetual validity. There is no renewal; instead you pay an annual fee of ₹2,000 to ₹5,000 depending on your kind of business, and manufacturers file an annual return on Form D-1.

Who Needs a State FSSAI License in India?

Any food business with turnover above ₹1.5 crore up to ₹50 crore at a premises, that is not in a central-only category, needs a state FSSAI license. Common examples:

  • Restaurants, bars, cafés and cloud kitchen hubs that have outgrown basic registration
  • Food manufacturers and processors, including bakeries, namkeen and snack units, flour, rice and dal mills, oil mills, dairies and spice units
  • Distributors, wholesalers, suppliers and marketers of food products
  • Cold storages and warehouses holding food for others
  • Caterers, canteens, banquet halls and mid-day meal caterers
  • Hotels up to four-star, including three- and four-star hotels
  • Food transporters with a fleet of vehicles
  • Units of multi-state businesses, where each unit is licensed by the state it is in and the head office holds a central licence

Businesses with turnover up to ₹1.5 crore need only basic FSSAI registration. Businesses above ₹50 crore, and importers, exporters, e-commerce operators and other listed categories, need a central FSSAI licence.

FSSAI State License Eligibility Under the 2026 Limits

FSSAI state license eligibility rests on two tests: your turnover, and the kind of business you run. Both must point to a state licence.

The turnover test

From 1 April 2026, FSSAI's revised limits put food businesses into three bands:

Annual turnoverWhat you needGranted by
Up to ₹1.5 croreBasic FSSAI registration (Form A)Registering authority of the district
Above ₹1.5 crore up to ₹50 croreFSSAI state license (Form B)State licensing authority
Above ₹50 croreCentral FSSAI licence (Form B)FSSAI central licensing authority

Turnover is counted for the premises being licensed, based on the business's accounts. Declare it honestly on FoSCoS: a turnover band that does not match your GST returns or accounts is a common reason for queries, and a business that understates turnover to stay on a lower category can face action.

The kind-of-business test

Some activities need a central licence whatever the turnover: importing food, exporting food, operating an e-commerce food platform, running a 100% export-oriented unit, operating a multi-state head office, and running five-star hotels, among other listed categories. If any of these apply, a state licence is not enough for that activity, even if your turnover is within the state band. Everything else in the ₹1.5 crore to ₹50 crore band, from restaurants and caterers to manufacturers and distributors, is a state license FSSAI case.

State vs central vs registration in one view

The difference between FSSAI state and central license, and between a state licence and basic registration, matters because the wrong category means the wrong authority, the wrong fee and, often, a rejected application. In short: registration for small businesses, a state licence for mid-sized businesses within one state, and a central licence for the largest businesses and listed categories. See our Central FSSAI License page for the difference between FSSAI state and central license in detail.

One licence per premises

A state FSSAI license covers one premises. A business with a factory, a warehouse and two outlets in the same state usually needs a licence or registration for each, according to each premises' own turnover and activity. Multi-state businesses hold a state licence for each unit in each state and a central licence for the head office. Planning the licences for every site together avoids gaps when you open a new outlet or move a warehouse.

Moving up or down under the 2026 limits

The 2026 limits moved many businesses between categories. Businesses that held a central licence with turnover between ₹20 crore and ₹50 crore, and are not in a central-only category, now fall under the state band; businesses that had a state licence with turnover below ₹1.5 crore now fall under registration. FSSAI's guidance allows existing licences to continue and sets out how businesses migrate; Regovex checks your current certificate and tells you whether to keep it, migrate, or apply afresh.

Documents Required for a State FSSAI License

The documents for a state FSSAI license depend on what you do at the premises. Every application needs a core set, and manufacturers need more. All documents should show the same business name and premises address as the FoSCoS application.

Core documents for every state licence

  • Form B, completed and signed on FoSCoS by the proprietor, a partner or an authorised director
  • Photo identity and address proof of the proprietor, partners or directors
  • List of directors or partners with full addresses and contact details, for companies and firms
  • Proof of possession of the premises: ownership deed, or rent or lease agreement with the owner's consent
  • Constitution proof: partnership deed, certificate of incorporation or memorandum and articles of association
  • List of food categories to be handled
  • Food Safety Management System plan, describing how food safety hazards are controlled
  • Authority letter or board resolution naming the person responsible for compliance, with Form IX nomination for companies where required
  • Declaration and undertakings required on FoSCoS

Additional documents for manufacturers and processors

  • Blueprint or layout plan of the processing unit, showing dimensions and operation-wise areas
  • List of equipment and machinery, with number, installed capacity and horsepower
  • Analysis report of the water used in manufacturing, from an FSSAI-recognised or NABL-accredited laboratory
  • Source of raw material for milk, meat and similar products, where applicable
  • Recall plan for the products manufactured
  • Certificate or plan for pest control, and hygiene and cleaning schedules
  • NOC from the manufacturer for businesses that relabel or repack

Additional documents by kind of business

Kind of businessTypical extra documents
Restaurants and caterersKitchen layout, list of food categories served, details of the Food Safety Supervisor
HotelsStar classification certificate where applicable, kitchen and storage layout
Distributors and wholesalersStorage premises proof, list of suppliers and their FSSAI numbers
Cold storage and warehousesStorage capacity, temperature control arrangements
TransportersVehicle details and registration, with the type of food carried
Dairy unitsMilk procurement and processing capacity, source of milk

How Regovex checks the file

We check each document against the FoSCoS form before filing: the premises address on the rent agreement, the electricity bill and the application must match; the food categories must cover every product; the layout must show what the inspector will see; and the equipment list must support the declared capacity. These checks are the main reason our state licence files pass scrutiny without repeated queries.

How to Apply for a State FSSAI License Online

Every state FSSAI license application is filed online on ONDLS or your state drug licensing portal. The process for a new licence in India runs like this:

  1. Confirm eligibility. Check your turnover band and kind of business, and confirm that no central-only category applies.
  2. Choose the food categories you will make, store, serve or sell; anything left out cannot be sold until it is added by modification.
  3. Prepare the documents for your kind of business, with the premises address matching everywhere.
  4. Create or log in to the FoSCoS account and fill Form B, choosing the correct kind of business from the portal's list.
  5. Upload the documents and pay the fee online for the number of years you choose.
  6. Scrutiny by the State Drug Licensing Authority, which may raise a query; reply completely within the time given.
  7. Inspection, where the authority orders one, especially for manufacturers and higher-risk businesses.
  8. Grant of the licence on Form C, with a 14-digit licence number, downloadable from FoSCoS.

Timeline for a state licence

The licensing authority must decide a complete application, including any inspection, within 60 days. Time spent waiting for your reply to a query does not count, so prompt, complete replies are the single biggest factor in how fast a state licence is granted. With a clean file, many state licences in India are granted well within this period.

FSSAI State License Fees in 2026

FSSAI state license fees are charged per year. Since April 2026, licences do not expire, so the fee is an annual fee rather than a renewal fee, and FoSCoS lets you pay for several years at once.

Kind of businessGovernment fee per year
Restaurants, caterers, clubs, canteens, distributors, wholesalers, retailers, suppliers, storage and transporters₹2,000
Manufacturers and processors with lower installed capacity, and smaller dairy units₹2,000
Manufacturers and processors with higher installed capacity, and larger dairy units₹3,000
Three- and four-star hotels₹5,000

The exact fee for your kind of business is shown on FoSCoS before payment, and Regovex confirms it in your quote. Fees are paid online to the state, separately from any professional fee.

Worked example

A bakery and snack manufacturer in India with a turnover of ₹8 crore and higher installed capacity needs a state licence at ₹3,000 a year. Paying for five years at once costs ₹15,000 in government fees. If the same business later crosses ₹50 crore, it moves to a central licence at ₹7,500 a year, and any fee already paid is adjusted when the licence is migrated.

FSSAI state license fees compared with registration and central licence

Licence typeTurnover band (2026)Government fee per year
Basic FSSAI registrationUp to ₹1.5 crore₹100
State FSSAI licenseAbove ₹1.5 crore to ₹50 crore₹2,000 to ₹5,000, by kind of business
Central FSSAI licenseAbove ₹50 crore, and central-only categories₹7,500

FSSAI state license fees are therefore far lower than the central fee, which is one reason many businesses between ₹20 crore and ₹50 crore welcomed the 2026 change. The fee you pay is the fee for your kind of business, not for your turnover; two businesses with the same turnover can pay different state fees if one is a trader and the other a manufacturer with higher capacity.

Upgrading From FSSAI Registration to a State FSSAI License

Many businesses in India start with a basic FSSAI registration and grow into a state FSSAI license. The upgrade is needed as soon as your annual turnover crosses ₹1.5 crore, or your production capacity crosses the registration limits for your kind of business.

When to start the upgrade

Do not wait until the year-end accounts confirm the higher turnover. If your monthly sales show you will cross ₹1.5 crore in the year, start the state licence application early, because a business must not operate at the licence level while holding only a registration. A state licence application filed in time also avoids awkward questions if a Food Safety Officer visits during the transition.

What changes when you move up

  • More documents: a food safety management plan, a full list of food categories and, for manufacturers, a layout plan, equipment list and water test report.
  • A higher annual fee: ₹2,000 to ₹5,000 a year instead of ₹100.
  • Possible inspection before grant, especially for manufacturers.
  • Returns: manufacturers start filing Form D-1 by 31 May each year.
  • Trained supervisor: at least one FoSTaC-trained food safety supervisor on site.

Migration under the 2026 limits

Where the change of category is caused by the revised 2026 limits rather than by growth, FSSAI's FAQs of 27 March 2026 say FoSCoS migrates the registration or licence automatically based on the business's self-declared turnover, keeps the same number, charges no modification fee and adjusts fees already paid against the new category. Many central licence holders with turnover between ₹20 crore and ₹50 crore have moved to a state licence in this way, unless they are importers or in another central-only category. Regovex checks that your declared turnover and kind of business are correct, because a wrong declaration can lead to action on inspection.

State FSSAI License for Cloud Kitchens and Online Food Sellers

Online food businesses in India are licensed by the same turnover test as any other business, but a few points need extra care.

  • Each kitchen needs its own licence. A cloud kitchen brand running three kitchens needs a licence or registration for each kitchen, based on that kitchen's turnover.
  • The licence address must match the listing. Delivery apps check the FSSAI number and address of the kitchen they list; a mismatch can get the listing paused.
  • Selling through your own website does not by itself make you an e-commerce food business operator needing a central licence, but running a marketplace for other sellers does. We confirm which applies before filing.
  • Display the licence number on the app, website, invoices and packaging, as FSSAI requires for food sold online.

For a growing cloud kitchen, the move from registration to a state FSSAI license usually happens when one kitchen crosses ₹1.5 crore in annual turnover.

What the Food Safety Officer Checks During a State Licence Inspection

For manufacturers and higher-risk businesses, the State Drug Licensing Authority usually sends a Food Safety Officer to inspect the premises before granting the state licence. The officer checks the premises against the general hygiene and sanitary practices in Schedule 4 of the licensing regulations. Typical checks include:

  • Premises: clean, well-lit and ventilated areas, walls and floors that can be cleaned, no open drains, and separation between raw and finished goods.
  • Water: potable water for processing, with a recent test report from a recognised laboratory.
  • Pest control: a pest control contract or records, and screens or other measures to keep pests out.
  • Equipment: food-grade equipment in good condition, matching the equipment list filed with the application.
  • Personnel: medical fitness certificates for food handlers, clean uniforms and head covers, and hand-washing facilities.
  • Records: purchase, production, storage and sale records, and a food safety management plan in use.
  • Storage: proper temperatures for chilled and frozen food, and first-in, first-out stock rotation.

Regovex prepares you for the inspection with a pre-inspection checklist and, where useful, a walk-through of the premises, so the officer's report supports the grant of the licence.

After the State FSSAI License Is Granted: Compliance That Keeps It Valid

A state FSSAI license no longer has an expiry date, but it can still be suspended or cancelled. Keeping it valid in India means four things: paying the annual fee, filing returns, staying inspection-ready and keeping the licence details up to date.

Annual fee instead of renewal

The annual fee for your state FSSAI license must be paid on FoSCoS before the period you have already paid for ends. If it is not paid, the licence can lapse and the business cannot lawfully operate until it is restored. Regovex tracks the due date and reminds you well in advance.

Annual return on Form D-1

Manufacturers, importers and certain other licence holders must file the annual return on Form D-1 by 31 May for the previous financial year. Late filing attracts a penalty of ₹100 per day of delay. Dairy manufacturers may have additional half-yearly returns. Regovex files these returns for you as part of the compliance plan.

Inspections and audits

the State Drug Licensing Authority can inspect any licensed premises at any time. Keep these ready:

  • The licence displayed at a prominent place in the premises
  • Water test reports and pest control records
  • Medical fitness certificates for food handlers
  • Supplier and purchase records, and batch or production records for manufacturers
  • A trained food safety supervisor on site

Modifications to the licence

Any change in the business must be reflected in the state licence by a modification application on FoSCoS. Common changes are new food categories, a change in installed capacity, a change of proprietor, partners or directors, and a change of address within the same district. A move to another district or state usually needs a fresh licence.

FoSTaC training

Every licensed food business must have at least one trained and certified food safety supervisor for every 25 food handlers, under FSSAI's FoSTaC programme. Regovex arranges this training for your team in India or online.

Common Mistakes in State FSSAI License Applications

Most delays and rejections of a state FSSAI license come from avoidable errors:

  • Wrong licence type. Applying for state when the business needs a central licence, or for registration when turnover is above ₹1.5 crore.
  • Wrong kind of business chosen on FoSCoS, which changes the fee and the documents asked for.
  • Missing food categories, which means products cannot be sold until a modification is approved.
  • Address mismatch between the rent agreement, utility bill and application.
  • Incomplete query replies, which stop the 60-day clock and delay the decision.
  • No water test report for manufacturers, or a report that is older than allowed.
  • Forgetting the annual fee after the licence is granted, which can lapse the licence.

Regovex checks every one of these points before filing, which is why our applications are rarely returned.

State License FSSAI for Different Food Businesses in India

The state license FSSAI process is the same for all businesses, but what the authority looks for changes with the kind of business.

Restaurants, cloud kitchens and caterers

Medium and large restaurants, cloud kitchens supplying through delivery apps, banquet caterers and canteens with turnover above ₹1.5 crore need a state licence. Delivery platforms check the licence number before listing, so the licence must match the kitchen address exactly.

Food manufacturers and processors

Bakeries, namkeen and snack units, spice grinders, flour mills, oil units, packaged food makers and beverage units need a state licence when their capacity and turnover fall within the state band. These files need a layout plan, equipment list, water test report and a food safety management plan, and are usually inspected before grant.

Dairy units

Milk chilling centres, dairy processing units and milk product makers within the state capacity limits need a state licence. Units above the central capacity threshold apply to the central authority instead.

Wholesalers, distributors and retailers

Traders, distributors, supermarkets and wholesale food stores in India with turnover between ₹1.5 crore and ₹50 crore apply for a state licence for each premises.

Storage and transport

Cold storage, warehouses and food transporters within the state turnover band need a state licence. Transporters with a fleet should list the vehicles in the application.

Hotels

Three- and four-star hotels need a state licence at a ₹5,000 annual fee. Five-star hotels apply to the central licensing authority.

Displaying and Using Your State FSSAI License Number

Once the state FSSAI license is granted, the 14-digit licence number becomes part of how your business presents itself. Using it correctly avoids penalties and builds trust with customers and buyers in India.

Where the licence must appear

  • At the premises: a copy of the licence displayed at a prominent place, where customers can see it.
  • On packaged food: the FSSAI logo and licence number on the label of every pre-packaged product, as required by the labelling and display regulations.
  • On menus and bills: restaurants and caterers show the licence number on menu cards, display boards or bills.
  • Online: delivery apps, your website and online listings must show the licence number of the kitchen or premises supplying the food.
  • On invoices: distributors, wholesalers and manufacturers print the number on invoices and delivery documents.

Why buyers ask for your state licence

Large retailers, hotel chains, institutional buyers and export houses check the state licence before adding a supplier. They look at three things: that the licence is valid on FoSCoS, that the food categories cover what you supply, and that the address matches the unit making the goods. A licence with missing categories or an old address can cost a supply contract even when the food itself is safe. Regovex reviews your licence against your current product list once a year so that it stays in step with your business.

Checking a state licence on FoSCoS

Anyone can check the status of an FSSAI licence on FoSCoS by entering the licence number. Customers and buyers increasingly do this before placing orders, so keep the annual fee paid and the details up to date. If the portal shows the licence as inactive, contact us at once so the cause can be fixed before it affects your sales.

FSSAI State License Consultant in India: Regovex Consulting

Regovex Consulting helps restaurants, cloud kitchens, caterers, food manufacturers, dairy units, distributors, wholesalers, cold storage operators and three- and four-star hotels in India get an FSSAI state license, filed correctly the first time. A state licence is granted by the state food safety department through the district Designated Officer, applied for on Form B and issued on Form C through the FoSCoS portal.

The first question is eligibility, and the limits changed in 2026. From 1 April 2026, a state FSSAI license is needed by food businesses with annual turnover above ₹1.5 crore and up to ₹50 crore. Below ₹1.5 crore, a basic FSSAI registration is enough; above ₹50 crore, or for importers, exporters and multi-state head offices, a central licence applies. Many businesses that held a central licence at ₹20–50 crore now fall under the state, and we help you confirm which side of the line you are on.
